READ MOREA California man has been awarded $80 million in a lawsuit against Monsanto. He alleged that exposure to glyphosate, the active ingredient in Roundup weed killer, led to his being diagnosed with a form of cancer known as non-Hodgkin’s lymphoma.
A San Francisco federal jury awarded the man $5.27 million in compensatory damages and $75 million in punitive damages. Jury members said that the man’s exposure to glyphosate was a significant factor leading to his diagnosis. The plaintiff in the case claimed that not only was Monsanto negligent in designing Roundup, the company also failed to properly warn consumers about the risks of using the product.
Bayer recently purchased Monsanto. The company issued a statement saying it will appeal the jury’s verdict. Bayer claims that the product does not cause cancer.
This is the second time in recent months that a jury has awarded a substantial amount of money to a plaintiff in a Roundup lawsuit. In 2018, a jury in San Francisco awarded a man $289 million. A judge later reduced that award to $78 million.
However, this is the first Roundup trial in federal court. This is considered to be a bellwether case, meaning that the verdict will likely have a major impact on other cases filed in that jurisdiction. There are approximately 11,000 other Roundup lawsuits pending in either state or federal courts.
